Article 2 – Applicability
These general terms and conditions apply to every offer made by De Hotpotshop and to every agreement concluded through our online store.
By placing an order, the customer agrees to these general terms and conditions.
Any deviations from these terms and conditions are valid only if agreed upon in writing.
Article 3 – Our Product Range
De Hotpotshop sells, among other things:

Hotpot pans

Hotpot boxes
-
Tableware and accessories
-
Hotpot soup bases
-
Dipping sauces
-
Other food products
All products are intended solely for normal household use.
Article 4 – Offers
We take great care to ensure that our products are presented accurately.
Images, descriptions, colours and specifications are displayed as accurately as possible. However, minor colour differences may occur due to screen settings.
Obvious errors, typographical errors or pricing errors do not bind De Hotpotshop.
Article 5 – Prices
All prices stated include VAT.
Any shipping costs will be clearly stated before the order is completed.
De Hotpotshop reserves the right to change prices at any time. Price changes do not affect orders that have already been confirmed.
Article 6 – Orders
An agreement is concluded once the order has been placed and payment has been successfully processed.
After receiving the order, the customer will receive an order confirmation by email.
We reserve the right to refuse an order in the event of:

obvious pricing errors;

fraud;
-
misuse;
-
incorrect customer information;
-
force majeure.
In such cases, any amount already paid will be refunded in full.
Article 7 – Payment
Payment can be made using the payment methods available during checkout.
An order will only be processed once payment has been successfully received.
Article 8 – Delivery
We aim to ship orders as quickly as possible.
The stated delivery times are indicative.
Exceeding a delivery period does not entitle the customer to compensation or termination of the agreement, unless otherwise required by law.
The risk of damage to or loss of the order transfers to the customer once the order has been delivered to the specified delivery address.
Article 9 – Right of Withdrawal
Consumers within the European Union have the right to withdraw from their order within 14 days of receiving it without giving a reason.

Article 10 – Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:

opened or damaged food products;
-
hotpot soup bases;
-
dipping sauces;
-
other food products;
-
custom-made products;
-
personalised items;
-
products whose seal has been broken after delivery and which cannot be returned for hygiene reasons.
Article 11 – Warranty
We guarantee that our products comply with the agreement, reasonable expectations and the applicable statutory warranty.

Article 13 – Liability
De Hotpotshop's liability is limited to the purchase price of the relevant product, unless the damage is caused by intent or wilful recklessness.
De Hotpotshop is not liable for indirect damage, consequential damage, loss of profit or other forms of business loss.
Nothing in these terms and conditions limits the statutory rights of consumers.
Article 14 – Intellectual Property
All texts, photographs, images, logos, designs and other content on this website are the property of De Hotpotshop or are used with the permission of the rights holder.
It is not permitted to copy, distribute or otherwise use such content without prior written permission.
Article 15 – Privacy
De Hotpotshop processes personal data exclusively in accordance with applicable privacy legislation (GDPR).

Article 16 – Force Majeure
De Hotpotshop is not liable for delays or failure to fulfil obligations resulting from force majeure.
Force majeure includes, among other things:

natural disasters;

war;
-
strikes;
-
pandemics;
-
disruptions affecting carriers;

internet or payment disruptions;
-
government measures.
During a period of force majeure, our obligations will be suspended.
Article 17 – Applicable Law
All agreements between De Hotpotshop and the customer are exclusively governed by Dutch law.
Disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.
Article 18 – Amendments
De Hotpotshop reserves the right to amend these general terms and conditions.
The most recent version will always be available on our website.
Amendments do not affect agreements that have already been concluded.
